1. Introduction
In relation to the parliaments considerations of proposals to the an act on hunting and game-administration the Minister of Environment notified the Parliamental Board of Environment that the board would receive a status-report of the administration of the contemplated rules regarding the possession of birds of prey and owls in captivity.These rules are laid down in statutory order no. 216 of 21. March 1994 regarding the possession of birds in captivity, which came into action on 8. April 1994. With the act a prohibition without a possibility of dispensation against the use of birds of prey and owls for hunting is introduced. The statutory order lay down regulations for the control of such possessions, and under which conditions such birds can be kept, etc.
2. Rules of the statutory order
A. Which possessions are allowed?
The statutory order distinguish between birds of prey and owls, which are indigenous to Denmark, and species not indigenous to Denmark, as it is possible to lay down stricter rules for indigenous species. This issue is referred to in the Minister of Environment's letter of 8. December 1992 to the Parliamental Board of the Environment.The statutory order prohibits possession of indigenous species. At the same time it is implied that the possessions that were lawfully established when the act came into force on 1. April 1994, were permitted to continue as hitherto. Such possessions were given a deadline to 1. June 1994 to register.
The Minister of the Environment and Energy has in the reply of questions no. 410 of 6. May 1996 and no. 569-573 of 5. July 1996 further accounted for, how this and other premises have produced the administrationen of the statutory order.
In conclusion it can be said that as the legal position is, no permissions to establish new possessions of indigenous species is granted, and that existing possessions of such species can continue and supplement the existing possession with species already in possession, but not with other species, unless they are non-indigenous to Denmark.
New possessions of birds of prey and owls can thus only be established with non-indigenous species. On this matter it is a condition, that the birds are legal according the rules put down in the Washington-convention and the EU-regulations issued to implementation of the convention in the community.
B. How is the possession?
All birds of prey and owls in captivity must be marked with a microchip and have drawn a bloodsample. The National Forest- and Nature Agency co-operate with four veterinarian practicioners in charge of this job. All possessions are checked and all birds are marked, etc. Offspring of such possessions must be marked and have bloodsamples drawn, if they are to stay in possession. If they are exported before they are one year old, there is no demand for marking, etc., but the agency can draw bloodsamples on a spot check basis or on specific suspicion of irregularities.A fee of 340 kr has been decided upon for the marking. The fee is to cover the factual expenses. The agency has only demanded payment for the marking of birds which were not in Denmark when the statutory order came into action. Of 1. January 1997 25 "paying" birds have been marked.
The Agency has made an agreement with the Researchcentre at Foulum about analyzing the bloodsamples. In the spring 1996 the centre was sent all the bloodsamples the Agency had had taken hitherto in order to develop a method of analysis. However, this have proven to be more complicated than first assumed, and the Agency didn't receive results of the first analyses until January 1997.
The price of this work is a start price of 22.000 kr and 600 kr for each bloodsample. To that price is added 15 percent overhead. In the nature of the case at least two samples must be analysed and often three in order to perform a relationship-control. In some cases a considerable amount of analyses is required before sufficient basis of judgment is established.
As of 1. February 1997 control of 12 samples have been performed and no illegalities have been found. However, for three of the samples it is necessary to perform additional analyses.
It is noted that analysis of the bloodsamples as a means of determining descent not always can be used, i.e. if bloodsamples from dead parents do not exist.
3. Development in the number of birds of prey and owls in captivity
In the enclosed annex 1 and 2 a list of the development in number of birds etc, within the individual species is made so that indigenous species are listed in annex 12 and others in annex 2.I conclusion it can be said that an increase in the number of non-indigenous birds of prey is noted. The number of owners of such has increased from 8 to 17 in the period between 1. April 1994 to 1. February 1997. The number of such birds has increased from 19 to 51.
Regarding the number of indigenous species the number of owners has decreased from 48 to 44 in the same period of time, while the number of birds has increased from 159 to 164.
The number of owners has been calculated by adding the number of owners per species. As some owners has several species, the total number of owners are less than respectively 17 and 44.
4. The expected development on the area
The purpose of prohibiting falconry and laying down rules on the control of the keeping of raptors is partly in order to lessen the interest of keeping birds of prey and owls, partly to protect the wild population of such birds by through effective control to make it difficult to possess birds taken in the wild.As mentioned, there has so far not been found "illegal" birds of prey or owls in captivity, and there are in the Agency's conception no need to tighten the control.
It is established that the number of raptors in captivity has grown since the regulation came into action. This development is mainly due to new keepers of non-indigenous species. It is also established that the number of owners of indigenous species is declining if only a little, but the number of such birds is roughly unchanged.
The Agency expects this tendency to continue, as no permissions to establish new possessions of indigenous species is granted, and according EU-rules it isn't allowed to prohibit import of non-indigenous species, as import is permitted according EU rules.
Annex 1
In annex 1 is listed the species listed in annex 1 of the Ministry of Environment statutory order no. 216 of 21. March 1994 regarding the possession of birds in captivity, i.e. the species of birds of prey indigenous to Denmark.Below is a list of both the individual species and of all together. The list includes all species marked. Offspring of owls, which has died or have been exported within a year from the date of hatching is not included in the list.
Moreover the total number of owners is calculated by an addition of owners per species. The true number of owners of birds of prey and owls is thus lower than this total, as one owner can possess more than one species.
