Statutory Order no. 216 of 21. march 1994 with regard to possesion of birds in captivity
In consequence of § 6, subsection 1 and 2, § 49, subsection 1 and 3, § 53 and § 54, subsection 3, in act no. 269 of 6. may 1993 on hunting and gameadministration and in consequence of § 30, subsection 1, § 70, § 72, § 73, subsection 4, and § 89, subsection 3, in act no. 9 of 3. january 1992 on the conservation of nature, it is decided:
Ch. 1: Definitions, etc.
§ 1. The statutory order applies to the possession of birds in captivity comprising
1) the possession of 1 or more birds of the species listed in annex 1 or annex 2, or
2) the possession of altogether 20 or more of the species listed in annex 3, or 2,
3) the possession of altogether 40 or more of all other species listed in annex 3
4) the possession of altogether 5 or more of all other species native to Denmark.
Stk. 2. The order does not apply to offspring laid as eggs in the same year according subsection 1, no. 3 and 4 .
Stk. 3. The order does not apply to the possession of birds regulated according the act regarding breeding of game and foxes.
§ 2.
A bird is considered bred in captivity in the second generation if the bird itself and both parents are born and bred in captivity.
Ch. 2: Birds of prey and owls
§ 3. Birds of prey and owls of the species listed in annex 1 must not be kept in captivity.
§ 4. Birds of prey and owls of species others than mentioned in annex 1 may only be kept in captivity after permission from The National Forest and Nature Agency.
Stk. 2. Permission according to subsection 1 implies that the birds are bred in captivity or legally acquired according to the rules laid down in section 5.
Stk. 3. Permission is granted on condition that
1) all birds of prey and owls are marked,
2) blood samples are taken of all birds of prey and owls, and
3) that The National Forest and Nature Agency at any time by producing legitimation unannounced has admittance to the premises in order to check that the conditions are met.
Stk. 4. Marking is done with microchips unless otherwise decided by The National Forest and Nature Agency.
Stk. 5. The National Forest and Nature Agency determines how blood samples are taken and where they are kept.
Stk. 6. The regulation in subsection 4.3 may at the discretion of The National Forest and Nature Agency be deviated for zoological gardens, if they receive state subsidies or are municipally owned.
§ 5. Import, export, and trade, et cetera of birds of prey and owls is encompassed in the council regulation (EEC) no. 3626/82 3 of 3 december 1982 regarding the implementation in The European Communities of the The Convention on International Trade with Endangered Species.
Ch 3: Other species
§ 6. The possession in captivity of birds of the species mentioned in section 1, except for birds of prey and owls is only permitted on condition that,
1) the birds are bred in captivity at least to the second generation,
2) the possession is reported to The National Forrest and nature Agency within one month after acquisition of the birds, and
3) the owner is keeping a register. The register must include any change in the possession of birds, registration of progeny, and registration from whom birds are acquired and to whom they are transferred.
Stk. 2. The register of the possession of birds must on request be surrendered to The National Forest and Nature Agency
Ch. 4: Exemption
§ 7. The National Forest and Nature Agency in special cases may make a derogation from the regulation laid down in section 3, if documented that the birds are bred in captivity at least to the second generation.
Stk. 2. In connection with the derogation mentioned in subsection 7.1, the conditions laid down in § 4, subsection 3 6
Ch. 5: Administration
§ 8. Reporting according § 6 and § 15 and application for permission or exemption according § 4, § 7 and § 14 must be done on a special form, available from the National Forest- and Nature Agency.
§ 9. The National Forest and Nature Agency may at any time revoke the permissions granted according the provisions in section 4.7, and 12 if the conditions are infringed or no longer fulfilled.
§ 10. The National Forrest and Nature Agency determines what to do with birds, the possession of which is no longer legal.
§ 11. The National Forest and Nature Agency charges a fee for the administration of permits, certificates, and arrangement of measures of control in pursuance of this statutory order, including expences in connection with the taking of blood samples and the marking mentioned in § 4 and § 7.
Stk. 2. The fee is 340 kr.
§ 12. The National Forest- and Nature Agency control that this order is being followed and that the conditions for permits and dispensations are met.
§ 13. Decisions made by the National Forest and Nature Agency by this statutory order cannot be brought before another administrative authority.
Ch. 6: Transitional provisions
§ 14. The National Forest and Nature Agency grant permission to owners of birds of prey or owls the possession of which is legal on 1 april 1994, with reference to current rules, according to the regulations set up in § 4, subsection 3 6 if an application has been presented to The National Forest and Nature Agency before 1 july 1994. If the application has been forwarded before this date, the possession of birds is legal from 1 april 1994 and until the decision of The National Forrest and Nature Agency is available.
Stk. 2. Permission according subsection 1 is conditioned that the National Forest- and Nature Agency, find it proved that the birds are legally acquired or bred in captivity.
Stk. 3. If application is not applied before 1. june 1994, the possession is illegal from this date. If permission according subsection 1 is not given, the possession is illegal from the date the decision of the National Forest- and Nature Agency is received by the applier.
§ 15. Other, on 1 april 1994 existing possessions of birds, are legal provided that
1) the possession is legal according to regulations in force prior to this date or bred in captivity
2) the possession is reported to The National Forest and Nature Agency before 1 july 1994, and
3) the owner keeps a current record of the possession, according § 6, subsection 1, no. 3.
Stk. 2. On demand the record must be supplied to The National Forest and Nature Agency.
§ 16. Expenditures on the first markings and blood samples from birds of prey or owls from existing possessions by 1. april according § 14 are paid by the government.
Ch. 7: Penalty and entry into force
§ 17. Unless a more severe penalty is provided for by other legislation, contraventions will be punishable with a fine,
1) of § 3, § 4, subsection 1, § 6, subsection 1, or § 15,
2) uden at have indgivet ansøgning om eller opnået tilladelse til bibeholdelse af eksisterende hold af rovfugle og ugler, jf. § 14, stk. 3, ikke afvikler fugleholdet, eller
3) if the owner against the provisions in § 6 subsection 2 or § 15 subsection 2 omits to surrender the record of possessions to the National Forest- and Nature Agency.
Stk. 2. The penalty may increase to ordinary imprisonment or imprisonment for 2 years if the contraventions were intentional or a result of gross negligence, and if the contravention has
1) caused considerably damage to the interests which legislation intends to protect cf. § 1 subsection 1 - 2 of the Conservation of Nature Act, or caused a risk as to these interests, or
2) obtained or aimed at a profit for the person concerned or others.
§ 18. The National Forrest and Nature Agency decides how to deal with birds including parts and products of these being confiscated in connection with contravention of the statutory order.
§ 19. This order enters into force 8. april 1994.
